You will need to know your infringement notice number, and vehicle registration (licence plate number) if it is a vehicle infringement. After you have viewed the infringement details, you can choose to pay or query the infringement.

Late submission of query

Late submission of a query is when there is less than 10 days before the final due date for payment.

If you are submitting a late query, please contact us to advise of the urgency required in dealing with your request.

You can also write us a letter. Please include these details in your letter: 

  • Infringement number
  • Vehicle registration number (if vehicle infringement)
  • Your full name
  • Date of birth
  • Address
  • A contact telephone number
  • A copy (not the original) of any supporting documentation you have, such as proof that your car has a current evidence of vehicle inspection.

Query a paid infringement

If you have paid the fine either before or after requesting a review, your correspondence will still need to be reviewed before any decision on a refund can be made.

You will receive a response informing you of a decision within 10 working days, either that:

  • we will proceed with the infringement notice, in which case, payment will have been received and the matter will be considered settled, or
  • the explanation warrants a cancellation of the infringement notice and the payment will be refunded.

Query for customer who has died

A query can be submitted to request a waiver for someone who has died. Family members, Power of Attorney or Executors of a Will can submit the query.

Please include a copy of one of the following documents with your request:

  • Copy of the death certificate
  • Copy of order of service, for example, from the funeral service
  • Copy of a death notice, for example, from a newspaper.

We appreciate that this can be a difficult task for family and friends. We respectfully ask that you provide us with the required information so we can provide a response as quickly as possible.


Court hearing

You can request a court hearing by completing and returning the court hearing request form. This form must be received by Auckland Transport before the last day for payment of the infringement (56 days from the infringement issue date). When we receive this form, we will advise you of the next steps.

Failure to inform Auckland Transport of your intentions to request a written submission, defended hearing or make payment by the due date may result in the infringement notice being lodged with Baycorp or the Ministry of Justice.

Stolen vehicles

If you wish to advise that the vehicle issued with an infringement has been stolen, please provide this information with your query:

  • Proof vehicle was stolen, eg Police report
  • Date when the vehicle was reported stolen
  • Whether the vehicle has been recovered

Breakdowns

If you wish to advise that the vehicle issued with an infringement had broken down, please provide this information with your query:

  • Proof of breakdown, eg mechanic's report or tow receipt
  • Date when the vehicle was broken down
  • Whether the vehicle has been repaired

Medical emergencies

If you wish to advise that there was a medical emergency when the vehicle was issued with an infringement, please provide this information with your query:

  • Proof of emergency, eg hospital report or doctor's report
  • Date of the emergency

Bankruptcy / Liquidation

Only infringement notices issued prior to the date of being made bankrupt or placed in liquidation (be that personal or that of a company) are eligible for cancellation.

Any notices issued after that date are a new “debt” and therefore, payment is required, unless another valid reason warrants cancellation of the infringement.

Any notices already lodged at court will need to be addressed by the liquidators.

Safety at the school gates policy

Auckland Transport has taken a serious approach to addressing the safety and congestion that often occurs outside school gates. Therefore, enforcement of a zero tolerance policy on parking infringements outside schools is in place.

It is imperative for motorists to ensure they park in a legal manner to ensure the safety of schoolchildren at all times.

The zero tolerance approach means that if parents, or other motorists, park illegally they will instantly receive an infringement notice. This approach is very successful and is helping reduce the danger to children as well as improve traffic flow around schools at this busy time of day.

Current licence label not affixed in prescribed manner - parked vehicle

Please provide evidence that supports any of these scenarios:

  • The infringement may be waived by way of warning if the licence label was valid. This exemption will be offered one time only.
  • The infringement may be waived if the time between being issued a warning and an infringement is less than 24 hours.
  • The infringement may be waived if a licence label was obtained within 30 minutes of the infringement being issued and the vehicle was parked in the vicinity of a Post shop.
  • The infringement may be waived if the licence was not expired by 28 days and a prior warning had not been given.

No evidence of inspection - private vehicle

  • The infringement may be waived if WOF was current but no hole was punched in it. You will need to provide proof that you have taken the vehicle back to the testing station to rectify problem.
  • The infringement may be waived by way of warning, if you can provide proof that the vehicle was being used to gain compliance, eg receipts for mechanical parts or repairs.
  • If the vehicle was in the care of the WOF provided or repairer, the infringement should be transferred to the liable party – see Transfer liability of vehicle infringement.
  • The infringement may be waived if the time between receiving a warning and an infringement is less than 24 hours.
  • The infringement may be waived if the WOF is not expired by 28 days and a prior warning has not been given.

No evidence of inspection - commercial vehicle

The infringement may be waived by way of warning if you can provide proof that the vehicle was being used to gain compliance, eg receipts for mechanical parts or repairs.

Parked in area reserved for disabled persons

The infringement may be waived if a valid permit can be provided. This exemption will be offered one time only, if both the driver and cardholder have not received a prior warning.

The infringement may be waived if the mobility card was expired but you can provide proof that you have applied and paid for a new card within 10 days of the infringement.

Parked a vehicle within 6 metres of a bus stop sign

There is only one bus stop sign required for this to be an offence.

Parked in prohibited area

The infringement may be waived if you can provide a valid parking permit for the area in question.

Failed to display red marker light on a Goods & Service Vehicle

The infringement may be waived if you can provide proof that the light was faulty and the problem was rectified within 24 hours of the infringement being issued. Please provide proof, eg receipt for the part or mechanics bill.

Parked on a loading zone

The infringement may be waived if the vehicle is a Goods & Service Vehicle* and you were using it to make a delivery/pick-up. Please provide proof, eg. delivery documents. For example if you were making a delivery to upper floors. Please provide proof, eg delivery documents.

*Definition of Goods & Service Vehicle: A motor vehicle that is designed exclusively or principally for the carriage of goods, or, a vehicle used for the collection or delivery of goods in the course of trade.

Double parked

The infringement may be waived if the vehicle is a taxi, you were using it to pick up or drop off customers, you showed due care and consideration for other road users and there was no alternative parking available. Please provide proof, eg log to show that a pick-up or drop-off occurred at that time.

The infringement may be waived if the vehicle is a Goods & Service Vehicle*, you were using it to pick up or drop off goods, you showed due care and consideration for other road users and there was no alternative parking available. Please provide proof, eg delivery documents.

*Definition of Goods & Service Vehicle: A motor vehicle that is designed exclusively or principally for the carriage of goods, or, a vehicle used for the collection or delivery of goods in the course of trade.
