Vehicle infringements are issued for offences related to vehicle condition, parking, and the use of bus and transit lanes.

Without parking and road rules our streets would be chaotic as people clog bus lanes or park wherever they want for as long as they want. Rules, fines and infringements are tools used in most cities to help moderate motorist behaviour, reduce traffic congestion and assist in the sharing of parking spaces.

The rules for road use and parking are mostly made at a national level, with some specific rules made for local conditions. The amount for fines is set at a national level.

Auckland Transport's Parking Officers are legally warranted to provide enforcement services for the rules that apply throughout Auckland.

Vehicle ownership

When a vehicle is bought and sold, both the buyer and seller are required by law to notify the New Zealand Transport Agency (NZTA) immediately. However, there are times when a vehicle changes ownership and the seller of the vehicle completes their section of the paperwork but the buyer does not, leaving the vehicle in the registered ownership of the seller.

If you receive an infringement notice for a vehicle after you had notified NZTA of the sale of the vehicle, you can request to transfer liability of the infringement to the new owner.

Auckland Transport has the authority to issue infringement notices to vehicle owners under this legislation:

Types of vehicle infringements

Unauthorised use of special vehicle lane

  • Person drove a vehicle on a road and used a special vehicle lane (eg; bus lane) reserved for a specific class or classes of vehicle other than the one being driven.
  • Section 40 of the Land Transport Act 1998 and Rule 2.3(1)(f) of the Land Transport (Road User Rule) 2004.
  • $150 - Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Current licence label not affixed in prescribed manner

  • Person operated a motor vehicle on a road when the current licence issued to the vehicle and appropriate for its use was not affixed to it in the manner prescribed.
  • Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011: Regulation 77(2)(b)(ii).
  • $200 - Schedule 6 Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011.

Failed to display red marker light on Goods Service Vehicle

  • Person left a goods vehicle with a gross vehicle mass over 3500kg or fitted with a tray for carrying goods on a roadway during the hours of darkness without displaying a clearly visible rearward-facing position lamp.
  • S.40 Land Transport Act 1998 & Rule 8.7(2) Road User Rule 2004.
  • $150 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

No evidence of inspection - private vehicle

  • Person operated a private vehicle on a road when the vehicle was not displaying current evidence of vehicle inspection.
  • s.34(1)(b) Land Transport Act 1998.
  • $200 – Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

No evidence of inspection - commercial vehicle

  • Person operated a heavy motor vehicle or vehicle used in a transport service on a road when that vehicle was not displaying current evidence of vehicle inspection.
  • s.34(1)(b) Land Transport Act 1998.
  • $600 - Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Obscured or indistinguishable registration plate

  • Person caused or permitted a vehicle to be on the road when the registration plate was obscured, or rendered or allowed to become not easily distinguishable.
  • Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011, regulation 87(2).
  • $200 – Schedule 6 Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011.

Parked vehicle displayed other than authorised registration plate

  • Person parked a motor vehicle on the road when it displayed a registration plate that was not authorised to be affixed to the vehicle under Part 17 of the Land Transport Act 1998.
  • Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011, regulation, 85(2)(a).
  • $200 Schedule 6 Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011.

Registration plates not affixed in prescribed manner

  • Person operated a motor vehicle on a road when the registration plates issued to the vehicle were not affixed to it in the manner prescribed by the Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011.
  • Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011, regulation 77(2)(b)(i).
  • $200 – Schedule 6 Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011.

Operated an unlicensed motor vehicle

  • Operated a motor vehicle on a road when it was not licensed in accordance with Part 17 of the Act.
  • Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011, regulation 77(2)(a).
  • $200 Schedule 6 Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011.

Operated vehicle with a damaged tyre

  • Operated on a road a vehicle when a tyre fitted to the vehicle had worn or damaged or visible cords apparent by external examination.
  • S.40 Land Transport Act 1998 $ Rule, s.2.3(5) & 4.1 Tyres and Wheels Rule 2001.
  • $150 Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Operated vehicle with a smooth tyre

  • Operated on a road a motor vehicle with a pneumatic tyre that had a tread pattern less than 1.5mm in depth.
  • S40 Land Transport Act 1998 & Rule 2.3(13) & 4.1 Tyres and Wheels Rule 2001.
  • $150 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Left passenger service vehicle unattended in stopping place

  • Person left a passenger service vehicle unattended in a stopping area reserved for vehicles of that class.
  • S.40 Land Transport Act 1998 & Rule 6.15(3) Road User Rule 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Small Passenger Service Vehicle driver not in attendance of vehicle

  • The driver of a small passenger service vehicle at a designated stand failed to remain constantly in immediate attendance of the vehicle.
  • Section 40 of the Land Transport Act 1998 and s3.3(16) Land Transport Rule: Operator Licensing 2007.
  • $200 - Rule 4 and Schedule 1 Land Transport (Offences & Penalties) Regulations 1999.

Small Passenger Service Vehicle inconsiderately stopped in road

  • Stopped small passenger vehicle on a road longer than was reasonably necessary.
  • Section 40 of the Land Transport Act 1998 and s3.3(12) Land Transport Rule: Operator Licensing 2007.
  • $200 – Rule 4 and Schedule 1 Land Transport (Offences & Penalties) Regulations 1999.

Small Passenger Service Vehicle not available for hire caused obstruction

  • Person used a small passenger service vehicle that was not available for hire in a manner that was likely to impede the operation of any vehicle that was available for hire.
  • Section 40 of the Land Transport Act 1998 and s3.3(11) Land Transport Rule: Operator Licensing 2007.

$200 - Schedule 1 Land Transport (Offences & Penalties) Regulations 1999.

Parked displaying an expired parking receipt - Auckland

  • Person failed to remove a vehicle parked in excess of the expiry time printed on the parking receipt.
  • Infringements are subject to incremental fines as follows:
    • Not more than 30 minutes - $12.
    • More than 30 minutes but not more than 1 hour - $15.
    • More than 1 hour but not more than 2 hours - $21.
    • More than 2 hours but not more than 4 hours - $30.
    • More than 4 hours but not more than 6 hours - $42.
    • More than 6 hours - $57.

  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked failing to display a parking fee receipt - Auckland

Person failed to display a pay and display parking receipt that showed that the fee payable has been paid for the entire time that the vehicle was parked in the area, either inside or on the vehicle.

  • Clauses 19(3) & 29 Auckland Transport Traffic Bylaw 2012.
  • $40 - Rule 4 and Schedule 1(b) Land Transport (Offences and Penalties) Regulations 1999.

Parked in excess of maximum time in a pay and display area - Auckland

  • Failed to remove a vehicle parked in excess of the maximum time declared for the pay and display area.
  • Infringements are subject to incremental fines as follows:
    • Not more than 30 minutes - $12.
    • More than 30 minutes but not more than 1 hour - $15.
    • More than 1 hour but not more than 2 hours - $21.
    • More than 2 hours but not more than 4 hours - $30.
    • More than 4 hours but not more than 6 hours - $42.
    • More than 6 hours - $57.

Parked over the time limit

  • Person parked a vehicle on a road where the maximum time a vehicle may park there was restricted by a traffic sign.
  • Overstaying infringements are subject to incremental fines as follows:
    • Not more than 30 minutes - $12.
    • More than 30 minutes but not more than 1 hour - $15.
    • More than 1 hour but not more than 2 hours - $21.
    • More than 2 hours but not more than 4 hours - $30.
    • More than 4 hours but not more than 6 hours - $42.
    • More than 6 hours - $57.
  • Section 40 of the Land Transport Act 1998 and Rule 6.4(1) Road User Rule 2004.
  • $12 - 57 Rule 4 and Schedule 1B Land Transport (Offences and Penalties) Regulations 1999.

Angle parked goods vehicle during hours of darkness

  • Person left a flat deck goods vehicle angled parked during the hours of darkness.
  • S.40 Land Transport Act 1998 & Rule 6.18(1) Road User Rule 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Double parked

  • Person double parked a vehicle.
  • Section 40 Land Transport Act 1998 and Rule 6.11 Road User Rule 2004.
  • $60 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Inconsiderate parking

  • Person stopped, stood or parked a vehicle without reasonable consideration for other road users.
  • Section 40 Land Transport Act 1998 and Rule 6.1 Road User Rule 2004.
  • $60 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Incorrect angle parking

  • Person parked a vehicle otherwise than at the correct angle, where angle parking is required.
  • Section 40 of the Land Transport Act 1998 and Rule 6.13 Road User Rule 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Incorrect kerb parking - left side of road

  • Person failed to park a vehicle parallel to and in the direction of the roadway, and as close as possible to the left.
  • Section 40 Land Transport Act 1998 and Rule 6.12 Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Incorrect kerb parking – one-way road

  • Person did not park a vehicle as close as practiable to the side of a one-way road.
  • S.40 Land Transport Act 1998 & Rule 6.12(2) Road User Rule 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked a trailer on a road over 5 days

  • Person parked a trailer on a roadway for a period exceeding 5 days.
  • Section 40 Land Transport Act 1998 and Rule 6.19(1) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked across vehicle entrance

  • Person stopped, parked or stood a vehicle on a road so as to obstruct entry to or exit from any driveway.
  • Section 40 of the Land Transport Act 1998 and Rule 6.9(1) Road User Rule 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked between fire hydrant and road marking

  • Person parked between the nearer edge of the roadway and a portion of a fire hydrant road marking.
  • Section 40 Land Transport Act 1998 and Rule 6.4(4) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked in an area marked by a broken yellow line

  • Person parked a motor vehicle in an area marked by a broken yellow line.
  • Section.40 Land Transport Act 1998 and Regulation 6.4(4) Road User Rule 2004.
  • $60 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked in an area reserved for disabled persons

  • Person stopped, stood or parked a vehicle in a parking area reserved for disabled persons when not entitled to do so.
  • S.40 Land Transport Act 1998 Rule 6.4(1A) Road User Rule 2004.
  • $150 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked in an area reserved for hire or reward vehicles

  • Person stopped, stood or parked a vehicle in an area reserved for a class of passenger vehicle and indicated by a sign, when that vehicle does not belong to the class indicated.
  • Section 40 of the Land Transport Act 1998 and Rule 6.15(2) Road User Rule 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked in a clearway

  • Person parked a vehicle on a road contrary to the terms of "clearway" signs erected by the road controlling authority.
  • S.40 Land Transport Act 1998 & Rule 6.4(1) Road User Rule 2004.
  • $60 Rule 4 and Schedule 1(b) Land Transport (Offences and Penalties) Regulations 1999.

Parked in a special vehicle lane

  • Person stopped, stood or parked the vehicle in a lane restricted to a specified class or classes of vehicle when that vehicle does not belong to that class.
  • S.40 Land Transport Act 1998 & Rule 6.6 Road User Rule 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked in prohibited area

  • Person stopped, stood or parked a vehicle on a part of the road contrary to the terms of a traffic sign, notice or road marking.
  • Section 40 of the Land Transport Act 1998 and Rule 6.4(1) of the Land Transport (Road User Rule) 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked near a level crossing

  • Person stopped, stood or parked a vehicle near a railway level crossing so as to obscure the view other road users had of the crossing or rail vehicle approaching the crossing.
  • S.40 Land Transport Act 1998 & Rule 6.17(b) Road User Rule 2004.
  • $150 Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked near corner bend rise or intersection

  • Person parked a vehicle on a road in a position such that it was likely to obstruct the view of another driver.
  • Section 40 of the Land Transport Act 1998 and Rule 6.3(1) of the Land Transport (Road User Rule) 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked near fire hydrant

  • Person parked a motor vehicle within 500mm of a fire hydrant.
  • Section 40 Land Transport Act 1998 and Rule 6.10(1) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on a flush median or traffic island

  • Person parked a vehicle on a road on a flush median or traffic island.
  • S.40 Land Transport Act 1998 & Rule 6.7 Road User Rule 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on a level crossing

  • Person stopped, stood or parked the vehicle on a railway level crossing.
  • S.40 Land Transport Act 1998 & Rule 6.17(a) Road User Rule 2004.
  • $150 Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on a loading zone – not loading or unloading

  • Person parked in a loading zone but did not load or unload the vehicle.
  • Section 40 Land Transport Act 1998 and Rule 6.16(1)(c) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on a loading zone – vehicle not of class specified

  • Person unlawfully parked a vehicle on an area reserved and sign posted as a loading zone.
  • Section 40 Land Transport Act 1998 and Rule 6.16(1)(a) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on a loading zone – vehicle unattended for more than the authorised time

  • Person left a vehicle unattended in a loading zone for more than the authorised maximum time.
  • Section 40 Land Transport Act 1998 and Rule 6.16(1)(b) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on footpath or cycle path

  • Person parked a motor vehicle on a footpath or cycle path.
  • Section 40 Land Transport Act 1998 and Rule 6.14(1) Road User Rule 2004.
  • $40 – Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on or near a pedestrian crossing

  • Parked a vehicle on or within 6m of the nearer side of a pedestrian crossing.
  • Section 40 of the Land Transport Act 1998 and Rule 6.5(1) of the Land Transport (Road User Rule) 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked on road when off-road park available

  • Person parked, stood or stopped a vehicle on the roadway when it was reasonably practicable to do so on the road margin.
  • S.40 Land Transport Act 1998 & Rule 6.2 Road User Rule 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked within 6m of an intersection

  • Person stopped or parked a vehicle on a road within 6m of an intersection.
  • Section 40 of the Land Transport Act 1998 and Rule 6.3(2) of the Land Transport (Road User Rule) 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked within 6m of indicated bus stop

  • Person parked a vehicle within 6m of an indicated bus stop.
  • Section 40 of the Land Transport Act 1998 and Rule 6.8(1) Road User Rule 2004.
  • $40 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked within an intersection

  • Person stopped or parked a vehicle within an intersection.
  • Section 40 of the Land Transport Act 1998 and Rule 6.3(2) of the Land Transport (Road User Rule) 2004.
  • $60 - Rule 4 and Schedule 1 Land Transport (Offences and Penalties) Regulations 1999.

Parked wrong way on one way street

  • Parked facing the wrong way in one way street.
